There is confusion in the regulated community about the effective date of OSHA''s steel erection rule, according to Washington, D.C., attorney Stephen Yohay of Arent, Fox, Kintner, Plotkin & Kahn, PLLC.

That''s because although the standard''s effective date was originally July 16, in its most recent regulatory agenda OSHA quietly changed this to Sept. 16.

Yohay believes that from a legal standpoint the government would have a hard time now enforcing the July effective date.

"But the point isn''t enforcement," he said. "Many in the regulated community want to comply voluntarily, and they need to know what is the effective date."
