Dec. 5, 2005
A Canadian commercial fishing operation is facing charges stemming from the diving death of one its workers in 2004.

Atlantic Fisheries Ltd. has been charged with seven violations of the Occupational Health and Safety Act in connection with a diving accident that occurred in the waters of Bay Bulls harbor in August 2004. The accident resulted in the death of a worker.

The charges being levied against Atlantic Fisheries relate to its alleged failure as an employer to ensure that its workers were made familiar with the hazards of the workplace and to ensure that the diving operation was conducted in accordance with the requirements of the Occupational Safety Code for Diving Operations.

The company's first court appearance is scheduled for Dec. 8 at Provincial Court in St. John's, according to the Newfoundland and Labrador Department of Government Services.
