The U.S. International Trade Commission (ITC) has begun an investigation of Crews Inc. of Memphis, Tenn., concerning sales of imported safety eyewear. The investigation is in response to a complaint filed March 31 by Bacou USA Safety and its subsidiary, Uvex Safety Manufacturing.
The complaint alleges violations of Section 337 of the Tariff Act of 1930 regarding importing and selling products that infringe patents owned by Bacou and that misappropriate Bacou''s trade dress. Crews must file a response within 20 days after being served.
The commission''s investigative attorney in this action is Steven A. Glazer of its Office of Unfair Import Investigations. Debra Morriss, an ITC administrative law judge, will schedule and hold an evidentiary hearing. Morriss will make an initial determination as to whether there is a violation of Section 337, with the initial determination subject to review by the commission.
