W.Va. Workers' Comp Commission Files Suit Against Eight Employers

The West Virginia Workers' Compensation Commission recently filed injunctions against eight employers whose accounts with the commission are in default.

Injunctions were filed in Kanawha County Circuit Court against:

  • Clearwater Timber Resources, a Pocahontas County lumbering, logging and timbering business, which owes back premiums, interest and penalties totaling $80,857.41;
  • Independent Transport Inc., a Pocahontas County trucking business, which owes back premiums, interest and penalties totaling $19,391.60;
  • TLC Clearing Inc., a Mingo County tree cutting business, which owes back premiums, interest and penalties totaling $11,089.84;
  • Springfield Coal Co., a Kanawha County surface coal and auger mining business, which owes back premiums, interest and penalties totaling $21,041.49;
  • A & K Casto Inc., a Kanawha County retail/wholesale and delivery business, which owes back premiums, interest and penalties totaling $11,929.73;
  • Dorothy L. Moss, dba Moss Trucking, a Kanawha County trucking business, which owes back premiums, interest and penalties totaling $11,996.44;
  • Jimmy E. Young, dba Jimmy E. Young Builders, a Kanawha County general building construction business, which owes back premiums, interest and penalties totaling $10,570.70; and
  • John Skeens, dba Quality & Pride Construction, a Logan County roofing and gutter installation business, which owes back premiums, interest and penalties totaling $16,687.15.

The injunctions call for the firms to cease business.

The commission will continue initiating litigation involving delinquent businesses throughout the state to help ensure that "everyone pays their fair share," according to Workers' Compensation Commission Executive Director Gregory A. Burton.
